OctBoss provides a cloud-based digital menu platform that enables restaurants and food service businesses to create, manage, and display their menus digitally via QR codes. The Service includes:

• Digital menu creation and management tools
• QR code generation for contactless menu access
• AI-powered menu scanning and digitization
• Analytics and reporting features
• Custom branding and theming options
• Multi-location management (on applicable plans)

3. Account Registration

To use OctBoss, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept all responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

OctBoss offers various subscription plans with different features and pricing. By subscribing to our Service, you agree to:

• Pay all fees associated with your chosen subscription plan
• Provide valid payment information
• Automatic renewal of your subscription unless cancelled
• All fees are non-refundable except as required by law
• We reserve the right to change our pricing with 30 days notice

5. User Content and Conduct

You retain all rights to the content you upload to OctBoss (menu items, images, descriptions, etc.). However, you grant us a license to use, store, and display this content as necessary to provide the Service.

You agree not to:

• Upload content that is illegal, harmful, or violates any laws
• Infringe on intellectual property rights of others
• Use the Service for any fraudulent or malicious purposes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service

6. AI Features and Accuracy

Our AI-powered menu scanning feature uses artificial intelligence to digitize menu content. While we strive for accuracy, you acknowledge that:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and verifying all AI-generated content
• We are not liable for any errors in AI-processed menu items
• Final menu content is your responsibility

7. Intellectual Property

The OctBoss Service, including its original content, features, and functionality, is owned by OctBoss and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach the Terms of Service.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

9. Limitation of Liability

In no event shall OctBoss, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your content

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

OctBoss does not warrant that the Service will be uninterrupted, timely, secure, or error-free.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
